1. Acceptance of Terms
Welcome to Everest Wireless Network Pvt. Ltd.. These Terms and Conditions ("Agreement") govern the provision, access, and use of Internet, broadband, data transmission, and enterprise solutions provided by Everest Wireless Network Pvt. Ltd. ("Company", "we", "us", or "our") to the subscriber ("Customer", "User", "you", or "your").
By signing the Service Order Form (SOF), completing online registration, or activating and using the Service, you acknowledge that you have read, understood, and agreed to be legally bound by this Agreement.

2. Service Terms & Equipment
2.1. Regulatory Compliance
The Company provides telecommunications and internet services under license issued by the Nepal Telecommunications Authority (NTA). This Agreement is made in strict accordance with the Telecommunications Act, 2053 (1997), Telecommunications Regulations, 2054 (1998), Electronic Transactions Act, 2063 (2006), and all operational directives issued by the NTA and the Ministry of Communication and Information Technology (MoCIT).
2.2. Customer Premises Equipment (CPE)
All hardware deployed at the Customer site to enable service delivery—including Optical Network Units (ONU), Fiber Routers, Media Converters, Wireless Radios, and Power over Ethernet (PoE) injectors—remains the exclusive property of Everest Wireless Network Pvt. Ltd., unless explicitly purchased and invoiced as Customer-owned property.
2.3. Equipment Care and Site Conditions
The Customer is responsible for:
- Providing stable, continuous electrical power (with adequate surge protection/UPS where necessary).
- Ensuring a safe, clean, and sheltered environment for CPE placement.
- Protecting equipment against physical damage, water entry, power surges, or unauthorized tampering.
2.4. Equipment Return and Replacement
- Damaged or lost Company-owned equipment resulting from negligence, voltage fluctuations, lightning, or unauthorized relocation will be repaired or replaced at the Customer's expense.
- Upon service termination or account deactivation, the Customer must return all Company-owned CPE in good working condition within seven (7) business days. Failure to do so will result in equipment recovery charges or forfeiture of security deposits.
2.5. KYC Mandate
In compliance with NTA regulations and national security standards, service activation is contingent upon the submission of verified, accurate KYC documents:
- Individual Subscribers: Copy of a valid Nepalese Citizenship Certificate, Passport, or Driving License, along with a recent passport-sized photograph.
- Corporate / SME / Institutional Subscribers: Copy of Company Registration Certificate, PAN/VAT Registration Certificate, Tax Clearance Certificate, Board Resolution authorizing service acquisition, and photo ID of the authorized representative.
The Customer must notify the Company in writing within seven (7) business days of any change in ownership, corporate status, legal name, primary contact details, or physical installation address.
3. Fair Usage Policy (FUP)
Residential and shared broadband packages are subject to a Fair Usage Policy to ensure equitable bandwidth distribution across subscribers.
Fair Usage Policy: Excessive data consumption exceeding predefined thresholds may result in temporary speed adjustments until the beginning of the next billing cycle. Dedicated Enterprise lines (SLA) are governed by specific contractual bandwidth parameters and are exempt from standard residential FUP limits.
3.1. Quality of Service (QoS): The Company endeavours to maintain network performance in accordance with the Quality of Service Bylaws prescribed by the NTA.
Force Majeure: The Company is not liable for service interruptions, latency, or degradation caused by factors beyond its reasonable control, including severe weather, optical fiber cuts on international upstream links, natural disasters, power grid failure, civil unrest, or legal/government directives.
4. Billing, Tariffs & Payment
4.1. Advanced Billing
All recurring broadband and internet services are billed in advance on a monthly, quarterly, semi-annual, or annual cycle as specified in the signed Service Order Form.
4.2. Statutory Levies and Taxes
All advertised or agreed package prices are subject to prevailing Government of Nepal taxes, including Value Added Tax (VAT), Telecommunication Service Charge (TSC), and any applicable regulatory fees.
4.3. Payment Due Date and Throttling/Suspension
- Invoices must be settled in full on or before the due date specified on the invoice.
- Late payments may incur late administrative fees or result in automated speed throttling, temporary service suspension, or account termination.
- A standard reconnection fee may be applied to reactivate accounts suspended due to non-payment.
5. User Responsibilities & Acceptable Use
5.1. Lawful Use
The Customer agrees to use the network strictly for lawful personal, commercial, or enterprise purposes in compliance with Nepalese laws.
5.2. Prohibited Network Actions
The Customer shall NOT:
- Engage in illegal Voice over IP (VoIP) bypass activities, illegal call termination, or any telecommunications fraud prohibited by the NTA.
- Resell, sublease, redistribute, or extend the Internet connection to external premises or third parties without explicit written consent and authorization from the Company.
- Host, transmit, or share content that is pornographic, unlawful, defamatory, inciting violence, or damaging to national harmony and security.
- Engage in malicious cyber activities, including Denial of Service (DoS) attacks, network scanning, distribution of malware/ransomware, or unauthorized access to remote systems.
5.3. Suspension and Termination
Termination by Customer: The Customer may request service termination by submitting a written notice at least fifteen (15) days prior to the expiration of the current prepaid cycle, subject to the settlement of all outstanding dues.
Termination by Company: The Company reserves the right to suspend or terminate service immediately without prior notice if the Customer breaches any term of this Agreement, engages in fraudulent or unlawful activities, or upon instruction from the NTA, court order, or authorized law enforcement agency.
6. Limitation of Liability & Data Privacy
6.1. Privacy Protection
The Company respects subscriber privacy and handles personal data and log records in accordance with relevant Nepalese privacy provisions and NTA compliance standards. For full details, see our Privacy Policy.
6.2. Mandatory Disclosure
The Company reserves the right to disclose subscriber account information, connection logs, or bandwidth records to statutory law enforcement agencies or regulatory bodies upon receipt of a valid court order, administrative subpoena, or legal directive from the Government of Nepal or the NTA.
6.3. Dispute Resolution
In the event of any operational or billing dispute, the parties shall first attempt to resolve the issue through good-faith negotiation. Unresolved disputes regarding service standards or tariff issues may be submitted to the Nepal Telecommunications Authority (NTA) for administrative review.
7. Governing Law & Jurisdiction
This Agreement is governed by the laws of Nepal, and any litigation arising hereunder shall be subjected to the competent courts of Nepal.
All services provided within the territory of Nepal are subject to local statutory regulations and legal jurisdiction under the Telecommunications Act, 2053, Electronic Transactions Act, 2063, and all applicable NTA directives.
